1. Acceptance of Terms

By accessing or using the Ground API and related services ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Ground provides an API for accessing classification and identification systems data, including:

• REST API at api.ground.fyi
• MCP server at mcp.ground.fyi for AI assistant integration
• Web interface at ground.fyi

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Acceptable Use

You agree not to:

• Exceed rate limits or attempt to circumvent them
• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization
• Use automated tools to scrape data beyond API limits

5. Service Tiers and Rate Limits

The Service is offered in multiple tiers:

• Free: 1,000 requests per hour
• Pro: 10,000 requests per hour
• Enterprise: Custom limits

We reserve the right to modify rate limits with reasonable notice.

6. Payment Terms

For paid tiers:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless required by law
• We may change pricing with 30 days notice
• Failure to pay may result in service suspension

7. Data and Content

The classification data provided through the Service is sourced from public standards and specifications. While we strive for accuracy:

• Data is provided "as is" without warranty of accuracy
• You should verify critical data independently
• We are not liable for errors in classification data

8. Intellectual Property

The Service, including its design, code, and documentation, is owned by Ground. Classification data itself may be subject to various public domain or open standards. You may use data retrieved from the API in accordance with applicable standards and these Terms.

9. Termination

We may suspend or terminate your access to the Service:

• For violation of these Terms
• For non-payment of fees
• For any reason with 30 days notice

You may terminate your account at any time through your account settings.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROUND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
